PAYMENT TERMS

A 50% non-refundable deposit is required no later than the scheduled kickoff meeting for work to begin.
The remaining balance is due upon project completion or project close, prior to final launch or transfer.
Final website files, transfer of ownership, launch access, or public delivery of the website will not be released until the remaining balance has been paid in full.
Invoices are due within the payment terms stated on the invoice. Late payments may delay project progress or delivery.

CLIENT RESPONSIBILITIES

To support a successful and timely project, the Client agrees to:

Attend scheduled meetings or designate a primary decision-maker
Provide requested content, images, logos, branding materials, login credentials, and other necessary assets in a timely manner
Ensure all provided materials are accurate, lawful, and approved for use
Review submitted work and provide feedback within a reasonable timeframe
Communicate approvals, revisions, and decisions promptly
Maintain the agreed payment schedule
Ensure they have authority to approve project decisions on behalf of their business or organization

Delays in receiving required materials, approvals, or communication may impact the overall timeline, project scope, and cost.

REVISIONS & SCOPE CHANGES

Reasonable revisions within the agreed project scope are included.
Additional revisions, new pages, major redesigns, advanced integrations, or requests outside the original scope may require a separate quote or additional hourly billing.
Any scope changes will be discussed and approved before additional work begins.

PROJECT TIMELINE

Project timelines are estimates and begin once the deposit, required access, and initial materials have been received.
Timelines may be extended due to delayed feedback, missing content, third-party platform issues, technical limitations, or approved scope changes.
Ak Creations is not responsible for delays caused by the Client or third-party vendors.

OWNERSHIP & INTELLECTUAL PROPERY

Upon receipt of full payment, the Client will own the final approved website content and deliverables created specifically for the project.
Ak Creations retains ownership of any pre-existing tools, templates, processes, frameworks, or design assets used in the development process unless otherwise agreed in writing.
The Client is responsible for securing rights to any third-party content, images, fonts, trademarks, or materials they provide.
Ak Creations reserves the right to display non-confidential portions of completed work in its portfolio, website, social media, or marketing materials.

HOSTING, DOMAINS & THIRD-PARTY SERVICES

Unless otherwise stated in writing, hosting, domain registration, email services, plugins, platform subscriptions, and third-party tools are separate costs paid directly by the Client.
Ak Creations may assist with setup and recommendations but is not responsible for pricing changes, outages, policy changes, or service interruptions caused by third-party providers.

TERMINATION POLICY

Either party may terminate the agreement with written notice.
In the event of termination:
The Client is responsible for payment for all work completed up to the termination date
The initial deposit is non-refundable once work has begun
Any completed deliverables paid for up to that date may be provided at the discretion of Ak Creations
Ak Creations reserves the right to pause or terminate a project for non-payment, lack of communication, repeated missed meetings, abusive conduct, or breach of agreement
Termination does not waive any outstanding payment obligations.

LIMITATION OF LIABILITY

Ak Creations is not responsible for any indirect, incidental, special, or consequential damages arising from the use of the website or related services.
Ak Creations makes no guarantees regarding increased traffic, sales, donations, leads, rankings, or revenue.
The Client is responsible for ongoing website management, security practices, content accuracy, and compliance unless covered under a separate maintenance agreement.

ACCPENTANCE TERMS

Unless otherwise stated in writing, hosting, domain registration, email services, plugins, platform subscriptions, and third-party tools are separate costs paid directly by the Client.
